The sentence condemning the Turin Court of Assizes for the many deaths caused by eternity in the Casale Monferrato area is a sentence that reports a crime of “environmental and intentional disaster and voluntary omission of caution.”
Creating future patients is not a meritorious work: after 30 years, for the first time, the case law finally accepts and certifies the responsibility of those who spread poisons in the environment, even in a negligent way, and issues a sentence of conviction.
This sentence may recall the environmental situation of which we are victims as a population that lives in the area of intensive grape cultivation. Thousands of tons of harmful toxic pesticides are scattered here annually, some of which are recognized as carcinogenic, teratogenic and endocrine disruptors, not only in the risk sheets themselves but also in the documents of the European community.
Recall that Italy consumes a third of the pesticides used throughout Europe.
Even pesticides, such as asbestos, especially those classified as toxic and harmful, act in a subtle way and produce their harmful effects after several years in adults, but especially in pregnant women and children. Hundreds of scientific studies confirm these relationships and we suspect that, even in our area, the accumulation of these pollutants in the territory produces a continuous increase in the incidence of malignant tumors. In fact, according to the E048 code data (ticket exemption for malignant neoplasms), in the Treviso ULSS7 the incidence of malignant tumors was + 4.5% in 2008, + 5.5% in 2009, + 7.2% in 2010 (with 10,350 cancer patients, one for every 20 inhabitants). We are waiting for the required data for 2011 from ULSS7.
On these risks and these data and based on the European precautionary principle, we too have submitted two complaints to the Public Prosecutor's Office, so that it investigates this problem of widespread pollution, and begins to investigate criminal liability for “voluntary omission of caution”, but also on the application of the European principle “polluter pays”, as was also done in the judgment against asbestos in Turin.
We think that immediately, in our territory of DOCG Prosecco, a series of preventive actions must be implemented based on the precautionary principle, a principle reaffirmed a few weeks ago by a decision of the Trentino Regional Administrative Court in favor of the municipality of Malosco (TN), which confirmed the ban on all toxic-harmful pesticides from all over the municipality, to maintain organic agriculture.
On these important problems, Praetor Guariniello said: “it is time to move on to the facts, with a National Prosecutor's Office specialized in these crimes, to intervene not only after the tragedy has occurred, but also with a systematic preventive action, without always waiting for the dead.”
